MIMIC LABS PERSONAL FABRICATION PERMISSION v1.0

1. PURPOSE

This permission is intended to allow an individual to hire a third-party fabrication or assembly service to produce a personal, noncommercial Dungeon Delver build or personal-use replacement parts from files lawfully released by Mimic Labs.

This permission is supplemental to the Open Community License v1.1 and any applicable add-ons identified with the released files. It does not replace or modify those licenses except to the limited extent expressly stated below.

2. PERSONAL FABRICATION PERMISSION

A noncommercial individual may provide covered manufacturing files to a third-party fabrication or assembly service solely for the purpose of producing:

a. one or more personal-use Dungeon Delver builds for that individual; or

b. personal-use replacement parts for Dungeon Delver hardware lawfully owned or personally fabricated by that individual.

The fabrication or assembly service may charge ordinary fees for materials, labor, machine time, setup, shipping, taxes, and related service costs.

3. LIMITS ON THE FABRICATION SERVICE

The fabrication or assembly service may use the covered files only as necessary to complete the specific personal order placed by the individual.

This permission does not grant the fabrication or assembly service any right to:

a. manufacture additional units beyond the individual’s order;

b. retain or reuse the files for unrelated future orders;

c. reproduce the design for another customer;

d. redistribute, publish, sublicense, or sell the files;

e. advertise the covered design as its own product;

f. offer the Dungeon Delver or covered components in a catalog;

g. maintain commercial inventory;

h. sell extra units, overruns, rejected units, or surplus parts;

i. use Mimic Labs branding, logos, certification marks, artwork, or packaging;

j. claim partnership, certification, approval, sponsorship, or endorsement by Mimic Labs; or

k. use the Dungeon Delver name as the service’s own product name.

The fabrication or assembly service may retain the files temporarily only when reasonably necessary to complete the order, address manufacturing defects related to that order, comply with applicable law, or maintain ordinary business records.

4. PROHIBITED USES

This permission does not authorize:

a. manufacturing for resale;

b. commercial production runs;

c. group buys;

d. crowdfunding fulfillment;

e. dealer or distributor activity;

f. inventory building;

g. repeated production intended to function as a business;

h. sale of complete Dungeon Delver keyboards;

i. sale of Dungeon Delver kits;

j. sale of collections of covered parts intended to function as a competing kit;

k. commercial reproduction of covered core assemblies; or

l. any attempt to avoid the commercial restrictions of the applicable license by dividing a product into separate listings, shipments, or transactions.

A use is not personal fabrication merely because the purchaser describes it that way. Quantity, frequency, advertising, organization, resale intent, and surrounding circumstances may be considered when determining whether a use is commercial.

5. PERSONAL BUILDS ARE NOT OFFICIAL PRODUCTS

A personally fabricated Dungeon Delver is not automatically:

a. manufactured by Mimic Labs;

b. inspected by Mimic Labs;

c. tested by Mimic Labs;

d. certified by Mimic Labs;

e. covered by Mimic Labs warranty;

f. eligible for Mimic Labs product support; or

g. authorized to use Mimic Labs branding or certification marks.

A person may truthfully describe a personal build as being based on released Dungeon Delver source files, but may not falsely imply official manufacture, certification, sponsorship, or approval.

6. NO TRADEMARK OR BRAND LICENSE

This permission does not grant any right to use the Mimic Labs name, Mimic Labs logo, Dungeon Delver name, Mimic Certified marks, compatibility badges, artwork, product renders, packaging, visual identity, or other branding except where nominative use is legally permitted to truthfully identify compatibility or source.

7. NO WARRANTY

The covered files and this permission are provided without warranties of any kind, to the fullest extent permitted by law.

Mimic Labs is not responsible for the quality, safety, accuracy, legality, regulatory compliance, workmanship, assembly, testing, or performance of any product or part made by a third-party fabrication or assembly service.

8. TERMINATION

This permission terminates automatically for any person or business that violates its terms.

Termination does not grant any right to continue manufacturing, distributing, selling, or using retained copies of the covered files beyond what is otherwise permitted by the applicable license.

9. SPECIAL PERMISSION

Mimic Labs may grant separate written permission for educational programs, accessibility needs, nonprofit workshops, repair organizations, research groups, community events, or other circumstances.

10. APPLICABILITY

This permission applies only when a Mimic Labs product page, source repository, or source release explicitly states that the Mimic Labs Personal Fabrication Permission v1.0 applies.

Where this permission conflicts with the Open Community License v1.1 or another applicable license, this permission controls only with respect to the narrow personal-fabrication rights expressly granted here. All other terms of the applicable license remain in effect.
